These terms govern your use of ServicePro, the on-demand services marketplace at www.myservicepro.co.za and its apps. By creating an account you agree to them.
ServicePro is a marketplace platform that connects customers who need services (such as plumbing, electrical work, or cleaning) with independent service providers. We facilitate the introduction, communication, and payment — the service itself is delivered by the provider. Providers are independent contractors, not our employees or agents.
When a customer accepts a provider's price, the customer pays the full amount up front through our payment providers (Paystack or Stripe). That money is held in escrow — the provider is paid only after the customer confirms the job is complete. On release, the provider receives 90% of the job amount and ServicePro retains a 10% platform fee.
Statutory cooling-off right (Electronic Communications and Transactions Act, s44): as a consumer entering into an electronic transaction, you ordinarily have the right to cancel within 7 days without reason or penalty. However, this right does not apply once a service has begun with your consent before the 7 days are up. Because ServicePro bookings are scheduled and typically begin within days of payment, by accepting a bid and scheduling a booking you consent to the provider's service commencing before the 7-day period ends, and the statutory cooling-off right no longer applies to that specific booking once work has started. Before work starts, you may still cancel under the "before payment" / dispute rules above.
You may not use ServicePro to: break the law; harass, threaten, or discriminate against another user; post false reviews, fraudulent jobs, or fake credentials; misrepresent your identity or qualifications; attempt to circumvent escrow by arranging payment outside the platform; scrape, reverse-engineer, or interfere with the platform's operation; or upload unlawful, defamatory, or infringing content. We may suspend or close accounts that breach these terms, with escrowed funds handled through the dispute process.
You keep ownership of content you post (profiles, portfolio photos, reviews) and grant us a licence to display it on the platform. Don't post content you don't have the right to share.
Please read this section carefully — it limits our liability to you.
ServicePro is a marketplace. We introduce customers to independent service providers and process payment on their behalf — we do not ourselves perform the plumbing, electrical, cleaning, or other work booked through the platform, and providers are independent contractors, not our employees or agents. We provide the platform "as is" and make no warranty as to the quality, safety, timing, or legality of work performed by a provider, or of a customer's conduct.
To the maximum extent permitted by law, ServicePro's total liability to you arising from your use of the platform — whether in contract, delict, or otherwise — is limited to the platform fees we actually earned from the specific booking giving rise to the claim, and we exclude liability for indirect, incidental, or consequential loss (such as loss of income or opportunity).
Nothing in this clause excludes or limits liability that cannot lawfully be excluded under South African law — including our liability for gross negligence, fraud, wilful misconduct, or death or personal injury caused by our own negligence, or any right you have under the Consumer Protection Act, 68 of 2008, that cannot be waived.
You agree to indemnify and hold ServicePro, its directors, and staff harmless against any claim, loss, or cost (including reasonable legal fees) arising from: your breach of these terms; your violation of any law or third party's rights; or your own negligent or wrongful acts or omissions in connection with a booking (for example, damage a provider causes on a job, or false information a customer or provider supplies).
Our Privacy Policy explains how we handle your personal information under POPIA.
If a disagreement arises, please first raise it through the in-app dispute process or Help Center — most issues are resolved there without needing lawyers or courts. If a dispute cannot be resolved this way, it will be subject to the exclusive jurisdiction of the South African courts, without limiting any right you have to approach an ombud, the National Consumer Commission, or the Information Regulator.
We may update these terms; material changes will be announced in the app and the effective date updated. You may close your account at any time — active bookings and escrow must first be completed or resolved.
These terms are governed by the laws of the Republic of South Africa.
